I am writing on behalf of the Texas State
Auditor's Office and the State Classification Office to request that you remove
from http://www.preciousheart.net/Equity_Documents/Watson-Wyatt_Survey.htm all
material that appears to be part of information furnished to you with a
covering letter dated March 22, 2002
pursuant to a Texas Public Information Act request.
This agency released the information to you
because state law, namely the Texas Public Information Law, Texas Government
Code ch. 552, requires it to do so. The
license agreement between this agency and Watson Wyatt, the owner of the
copyright for this material, prohibits the redistribution of this material.
Posting proprietary data on a website appears, without question, to violate the
prohibition on redistribution. This was not a foreseeable use. I attach as
Exhibit A a copy of my March 22, 2002 letter. Portions of the letter addressing
the copyright issue are highlighted in red.
Although the term used in the first paragraph
of this email is "request," this message constitutes a legal demand
that you remove from the website, and refrain from publishing it again by any
means, whether electronic or otherwise, any and all material you obtained from
the State Auditor's Office and State Classification Office that came from
copyrighted sources published by Watson Wyatt.
If you have any questions about the contents
of this letter, please call me at 512-936-9370. If the copyright-protected
material is still available by 2 p.m. Central Standard Time tomorrow,
Wednesday, January 8th, 2003, on the preciousHeart.net or anything appearing to
be a related site, we will notify Watson Wyatt that we have detected an
unauthorized use of its data, so that the copyright holder can protect its
interests.
